ARVIND KEJRIWAL OUT OF JAIL, CAN
NOT GO TO OFFICE AND SIGN FILES
Delhi Chief Minister Arvind Kejriwal was granted bail by the Supreme Court on Friday after approx six month in a liquor excise corruption case that was presented by the CBI in connection with the Excise Policy Scam. The court also declared that keeping Kejriwal, AAP leader in jail for a long time would be equivalent to the Government depriving him of justice. The Justice Surya Kant and Justice Ujjwal Bhuyan granted Kejriwal bail in exchange for an amount of Rs 10 lakhs.
The Aam Aadmi Party's leader has been granted bail in the Enforcement Directorate case, which means he may be released after nearly six months in jail without a hearing. Justice Bhuyan and Justice Kant Agree: Delhi Chief Minister Kejriwal Should Be Released After Disputed Arrest.
In a short session Friday morning, Justice Ujjal Bhuyan and Justice Surya Kant gave separate findings on Mr Kejriwal's two pleas, but both agreed that the Chief Minister should be released. Mr Kejriwal had also disputed the CBI's arrest, which occurred days after the trial court in Delhi granted him bail in the ED case and was described by his attorneys as a "insurance arrest".
Judges Split on CBI Arrest of Kejriwal : Justice Bhuyan Questions Timing, Justice Kant Sees No Issue.
They disagreed on this, with Justice Kant stating "no impediment" to the CBI's arrest, but Justice Bhuyan questioning why the agency had been involved "only after the trial court granted bail in the ED case" an as it had done for Mr Sisodia, the court said it was a "travesty of justice" to hold Mr Kejriwal in jail without notice of a trial, especially because he had previously been granted bail in the ED case in which he faced charges under the severe Prevention of Money Laundering Act. "I don't understand the CBI's sense of haste in arresting appellant when he was about to be released in the ED case. (Additional Solicitor General SV) Raju (posing for the CBI) fiercely contended that the appellant must first approach the trial court, which cannot be accepted," Justice Bhuyan stated.
Judge Emphasizes 'Bail is the Rule, Jail is the Exception' in Kejriwal Case.
In powerful remarks, he also stressed the 'bail is the rule, jail is the exception' legal principle, which helped Mr Sisodia and Ms Kavitha be released.Further detention by the CBI for the same predicate crime is inadmissible. There is presumption of innocence. Bail is the rule, while jail is the exception. Interacting
Supreme Court Reaffirms "Bail is the Rule"

Sunita Kejriwal Claims BJP's Plans 'Washed Away' After Supreme Court Grants Bail.
Sunita Kejriwal, Arvind Kejriwal's wife, stated on Friday that the Bharatiya Janata Party's plans "washed away" when the Supreme Court granted bail to the Delhi chief minister. Sunita, who campaigned during the Lok Sabha elections without her husband, accused the BJP of imprisoning opposition politicians in order to "maintain power." The plans of the BJP have been swept away. They seek to keep their control by imprisoning opposition leaders. "Their only goal is this," she told reporters.
Manish Sisodia Accuses BJP of Using CBI to Imprison Kejriwal, Says Supreme Court's Ruling Exposes Agenda.
Manish Sisodia, Arvind Kejriwal's former deputy who was freed from jail last month after being imprisoned for over 18 months in the Delhi excise policy case, claimed the CBI intended to keep him in jail at the request of the BJP. The BJP has been exploiting the agencies to lock Arvind Kejriwal in prison. The Supreme Court stated today that the way Arvind Kejriwal was detained made it evident that the CBI intended to keep him in jail and given that Kejriwal has done nothing illegal, what was the objective here? It was from the BJP. That's why he was arrested by the CBI just as he was about to be released in the ED case. The CBI arrested him not because he was corrupt but because the BJP wanted to. Today, the Supreme Court authorized this. He stated that the BJP was exposed in the Supreme Court today.
According to BJP spokesperson Gaurav Bhatia, the court has shown Kejriwal the mirror and the Aam Aadmi Party (AAP) leader has no moral standing to hold a constitutional post. The Bharatiya Janata Party (BJP) sought Arvind Kejriwal's resignation on Friday, citing the Supreme Court's finding that his arrest was valid while granting the Delhi chief minister bail. Bhatia reminded Kejriwal of his words calling on lawmakers suspected of misconduct to resign immediately. "Why had he said that earlier? "It has been six months, and he is still in office," Bhatia said. He emphasized the terms for Kejriwal's bail, claiming they reflect the severity of the allegations against him.
